Terms of Service

These Terms of Service (“Terms”) govern your access to and use of RPAlert (“Service”), operated by Yositech (“we”, “us”, or “our”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Service Description
RPAlert is a web performance monitoring service that detects performance regressions in your web applications and delivers alerts via Discord and other channels.
2. Account Registration
2.1 You must sign in with a valid GitHub account to use the Service.
2.2 You are responsible for maintaining the confidentiality of your API keys and account credentials.
2.3 You must be at least 13 years of age to use the Service. If you are under 18, you must have parental or guardian consent.
3. Acceptable Use
You agree not to:
- Use the Service in a way that violates any applicable law or regulation
- Attempt to reverse engineer, decompile, or disassemble the Service
- Use the Service to monitor applications you do not own or have explicit authorization to monitor
- Abuse rate limits or attempt to circumvent usage restrictions
- Transmit any harmful, illegal, or offensive content via the Service
- Transmit sensitive personal data, confidential credentials, or other restricted information through monitored page URLs or application identifiers
We may suspend or restrict accounts that generate excessive traffic, attempt to bypass usage limits, or otherwise threaten the stability or security of the Service.
4. Subscription and Billing
4.1 Plans.

4.2 Billing. Paid plans are billed in advance on a monthly or annual basis via Stripe. All prices are in USD and exclusive of applicable taxes.
4.3 Cancellation. You may cancel your subscription at any time from the Settings page. Cancellation takes effect at the end of the current billing period; no prorated refunds are issued for unused time.
4.4 Refunds. We do not provide refunds except where required by applicable law. If you believe you were charged in error, contact us within 14 days.
4.5 Price changes. We reserve the right to change subscription prices with 30 days' advance notice. Continued use after the notice period constitutes acceptance of the new pricing.
5. Data and Privacy
5.1 Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
5.2 You retain ownership of all data you submit to the Service. You represent and warrant that you have the legal right to submit any data transmitted through the Service. We process your data solely to provide the Service.
5.3 Performance metrics collected via the RPAlert SDK are stored for the duration specified by your plan (7, 30, or 90 days) and then automatically deleted. You acknowledge that monitoring data may be deleted according to plan retention limits or due to technical constraints.
6. Intellectual Property
The Service and its original content, features, and functionality are owned by Yositech and are protected by international copyright, trademark, and other intellectual property laws.
The RPAlert open-source SDK is separately licensed under the MIT License.
7. Service Modifications
We may modify, suspend, or discontinue parts of the Service at any time, including features, usage limits, or plan structures. We will provide reasonable notice of material changes where practicable.
8. Availability and SLA
We strive for high availability but do not guarantee uninterrupted access. The Free plan is provided as-is with no uptime commitment. Paid plans benefit from best-effort support but carry no formal SLA unless agreed upon in a separate enterprise agreement.
Notifications delivered through third-party services (such as Discord or email providers) may be delayed or fail due to factors outside our control. We are not responsible for the availability or performance of third-party services.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Yositech shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
(a) your use or inability to use the Service;
(b) any unauthorized access to or use of our servers and/or any personal information stored therein;
(c) any interruption or cessation of transmission to or from the Service.
Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
11. Termination
11.1 We reserve the right to suspend or terminate your account at our discretion if you violate these Terms, with or without prior notice.
11.2 Upon termination, your right to use the Service ceases immediately. Data associated with your account will be deleted within 30 days.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court.
13. Force Majeure
We are not liable for any failure or delay in performing our obligations where such failure or delay results from events beyond our reasonable control, including but not limited to internet outages, cloud provider failures, natural disasters, or governmental actions.
14. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or by a prominent notice on the Service at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance.
